What

The aim of this programme is to review how recent problems in liquidity are impacting upon loan agreements and security documentation. Specifically it´s focused on market disruption in terms of problems with Libor/ Euribor/Hibor calculation. Reliance on the market disruption clause and problems of activation will be discussed. The implications of activation and also alternative methods of interest calculation in times of economic crises will be reviewed. In addition, recent developments in insolvent lender clauses and debt buy back options will be assessed. Finally, changes in the negotiation environment will be considered.
