AmCham would like to invite you for a presentation held by the Senate of the Czech Republic on Consitutional Complain against Reimbursement Directive. Large group of 48 Senators across political parties recently petitioned the Constitutional Court to abolish so-called Reimbursement Directive and parts of related reimbursement regulation. This regulation governs distribution of annual 300-billion health care budget, significantly impacts real-life access to unpaid health care, determines to a large extent financial health of hospitals and other providers, and affects also secondary markets of pharmaceuticals and medical devices. The Senators challenge the regulation on the basis of absence of transparency, creation of perverse incentives and market failures, absence of procedural remedies and general absence of rule of law in reimbursement governance. The Constitutional complaint is fiercely opposed by established providers, Governmental response is currently pending. Potential success before Constitutional Court would necessitate a major reform of health care reimbursement system. The seminar will address following topics: What system failures do the Senators challenge and why? What risks and opportunities does this Constitutional challenge present, what is the expected Court decision and its timeline? What reform steps could be considered after the Court decision?
